Before Death 

If you want to draft and record a Transfer on Death Deed (“TODD”), our office will not provide advice on how to do this. We recommend you seek the advice of an attorney well-versed in estate planning, tax law, and real property law, as there may be unintended consequences to using a TODD. If you still wish to draft and record your own TODD, you can find a blank form through the Minnesota Department of Commerce’s Uniform Conveyancing Blanks (“UCB”).  

After Death

In Ramsey County, Examiner approval is not necessary.  Assuming the information on the Affidavit of Identity and Survivorship for Transfer on Death Deed is correct (e.g. names spelled correctly, accurate legal description, etc.), once it is signed and notarized, you can go ahead and submit the Affidavit of Identity and Survivorship for Transfer on Death Deed, certified copy of Death Certificate, and M.A. Clearance Certificate for recording in Torrens.
